MAY FACE MANSLAUGHTER CHARGES AS MAN HIS AUTOMOBILE STRUCK DIESCALDWELL, O., Dec. 6 - Raymond Smithberger, 20, of near Summerfield, may face a manslaughter charge as the result of the death of John Miller, 78, East Union, who died late Sunday as the result of injuries sustained Saturday afternoon when struck by an automobile driven by the youth. Smithberger is the son of Mr. and Mrs. George Smithberger, who live between Carlisle and Summerfield. The accident occurred about 5 o?clock Saturday afternoon about seven miles east of Caldwell, near East Union. Miller was struck by the car and it passed over his body. He was taken to the home of John Clark, where he passed away. Sheriff Roy Shaffer was called and he placed Smithberger under arrest. He was charged with driving while intoxicated and with reckless driving. The youth secured an attorney who obtained his release on a small bond Sunday afternoon, following his appearance in Mayor W. D. Radcliff?s court. Smithberger was accompanied by three other persons. They were permitted to return to their homes with no charges being filed against them. Miller, whose wife died some time ago, was living at the home of his daughter, Mrs. Ira Clark, of East Union. He is survived by several children, most of whom live at distant points. He was well known throughout Noble County.

MAN TREATED HERE AFTER BEING SHOT
Earl Smithberger, about 35, of Summerfield Route 1,
received treatment at Good Samaritan hospital last night
for what was reported to be a gunshot wound in his right
side.
It was first believed that Smithberger has been hit by a
single bullet but it was understood that treatment revealed
a number of pellets had lodged in his side.
The Monroe County sheriff?s office said it received a re-
port the shooting occurred in a tavern but the Noble County
sheriff?s office, which apparently has jurisdiction in the case,
said it had nothing to report.
Smithberger was brought here in a Brubach ambulance
from Summerfield. The attendant reported he picked up
the wounded man at his home after being called by the
father, Raymond Smithberger.
Smithberger was admitted to the hospital at 7:45 p.m.

2 YOUTHS HURT IN NOBLE COUNTY
Two Caldwell area youths were injured Wednesday evening in a car-motorcycle
collision on U.S. 21 in Ava. Reported in fair condition at Good Samaritan Hospital
were Robert S. Smith of Caldwell Route 1 and David M. Warner of Caldwell Route 5.
Both are 17.
Both reportedly sustained leg fractures, cuts and bruises. The mishap occurred at
5:33 p.m. Wednesday and was under investigation by the Highway Patrol and Noble
