DRIVER FREED IN CRASH CASE
After 16 state's witnesses had testified against him in a two-day County Court trial, Ali DiPaolo, 32-year-old
steam shovel operator, yesterday was cleared of criminal negligence and second degree manslaughter charges
by Judge William F. Lynn.
Indicted by a Grand Jury that recommended clarification of the criminal negligence statute, DiPaolo was fred
whe Judge Lynn dismissed the two indictments at the close of the prosecution's evidence.
DiPaolo was arrested Dec. 30 after a two-car collision at the Dewey Ave. and Merrill St. that clained the life
of Raymond Reinagel, 35, of 58 Studley St., driver of the other car. Witnesses testified DiPaolo;s automobile
was traveling at 30 miles an hour on icy pavements when the crash occurred.
In seeking dismissal of the charges, Edward M. Ogden, attorney for DiPaolo, declared the prosecution had
failed to produce any evidence to prove his client's guilt. "On the contrary," Ogden said, "the state's own case
has strangthened our contention that he was using reasonable caution in operating his automobile."
Judge Lynn ruled the accident resulted from "an error of judgement" and that no evidence had been
introduced to support a criminal negligence count that DiPaolo had been driving his car in disregard for the
rights of others.
Mrs. Rosalie Reinagel, widow of the accident victim, will institute a civil action against DiPaolo, accusing
him of negligence, it was disclosed in papers filed in Surrogate's Court. Letters for administration of the
estate were granted to the widow by Surrogate Joseph L. Feety for the purpose of bringing the second action.
