    MAY FACE MANSLAUGHTER CHARGES AS MAN HIS AUTOMOBILE STRUCK DIES CALDWELL, O., Dec. 6 - Raymond Smithberger, 20, of near Summerfield, may face a manslaughter charge as the result of the death of John Miller, 78, East Union, who died late Sunday as the result of injuries sustained Saturday afternoon when struck by an automobile driven by the youth. Smithberger is the son of Mr. and Mrs. George Smithberger, who live between Carlisle and Summerfield. The accident occurred about 5 o?clock Saturday afternoon about seven miles east of Caldwell, near East Union. Miller was struck by the car and it passed over his body. He was taken to the home of John Clark, where he passed away. Sheriff Roy Shaffer was called and he placed Smithberger under arrest. He was charged with driving while intoxicated and with reckless driving. The youth secured an attorney who obtained his release on a small bond Sunday afternoon, following his appearance in Mayor W. D. Radcliff?s court. Smithberger was accompanied by three other persons. They were permitted to return to their homes with no charges being filed against them. Miller, whose wife died some time ago, was living at the home of his daughter, Mrs. Ira Clark, of East Union. He is survived by several children, most of whom live at distant points. He was well known throughout Noble County.
